Summary of general skilled migration information

Australian Immigration - the Australian migration program offers places for skilled migrants intending to apply for an Australian Skilled Visa. Age, Qualifications, experience and other factors are considered.

The skill stream of Australia's migration program is intended for people who are highly skilled, are under 45 and who will quickly make a contribution to the Australian economy.

  • To make a valid application, applicants or their spouses must be able to satisfy these basic requirements.
  • If you are not able to satisfy these basic requirements, you should not continue with a skilled migration application.

To apply for migration, you need to select an appropriate visa. These are organised into three categories:

  1. general skilled - for overseas applicants not currently in Australia;
  2. overseas student - for overseas students currently studying in Australia;

Within these three categories, there are the following types of visas:

Skilled - Independent (136)

  • Applicants for the 136 Skilled -Independent Visa must meet the following basic requirements:-
    • must have an occupation or skill on the list of approved occupations for skilled migration,
    • must be under 45 years old at the time of their application,
    • must have at least vocational English,
    • must pass a points test.

Skilled - State/Territory Nominated Independent (137)

  • Should an applicant for the Skilled - Independent Visa lodge an application, but not attain the pass mark (120 points) in the points test, but meet the basic criteria and have a score in the "pool mark", the applicant may apply for the skills matching visa. The applicant will be required to complete the skills matching section of the application form and will be required to seek sponsorship from an Australian State or Territory Government Agency.

Skill Matching (134)

  • Not points tested, but still subject to the basic requirements for skills visas :-
    • must have an occupation or skill on the list of approved occupations for skilled migration,
    • must be under 45 years old at the time of their application,
    • must have at least vocational English,
    • The applicant is required to submit payment (skills matching fee) whereafter his/her details are placed in the skills matching database. An employer or a State or Territory Government may then nominate the applicant for a visa.

Skilled - Designated Area Sponsored (139)

  • If the applicant can evidence that he / she has a relative relative in Australia who has lived in a "designated area" for more than 2 years and the relative is able to act as sponsor - this visa may be applied for.
  • Not points tested, but the applicant is required to meet the basic criteria.
  • Eligible sponsors are a parent, a non-dependent child, a grandparent, a brother or sister, an uncle/aunt, or first cousin of the main applicant.

Australian Sponsored (138)

  • If you have an eligible sponsor relative in Australia, and you meet the basic criteria for skills visas (including points test requirements)- you can apply for this visa. The pass mark is 110 points, with the sponsorship contributing 15 points.
  • Your relatives can live in any city, state or territory.
  • Relatives eligible to sponsor this category of visa must be a parent, a non-dependent child, or a brother or sister of the main applicant.

Skilled Overseas Student Visas (880, 881, and 882)

  • International students that successfully complete tertiary qualifications in Australia can apply to remain in Australia permanently under these visa sub classes (subject to meeting the criteria).
  • Requirements:-
    • Applications must be made while the former student is still in Australia,and
    • within 6 months of completion of a diploma, degree, or trade certificate for award by an Australian educational institution after at least 2 years of full time study in the English language medium at that institution in Australia, and
    • the qualification should lead to a positive assessment of the applicants skills by the relevant Australian authority, and
    • the occupation must be on the SOL.
    • The applicant must be under 45 and must meet the basic requirements for skilled migration.

Graduate - Skilled visa (subclass 497)

  • a temporary visa allows student visa holders to remain in Australia for up to 6 months while their application for a permanent Skilled Overseas Student visa is being processed.
  • Applicants should apply for the 497 visa immediately after completing their qualification, before their student visa "expires", and in this time, have their occupation assessed by the relevant authority for their occupation.

880 Independent Overseas Student visa

  • applicants must have a successful skills assessment for a skilled occupation assigned at least 60 points on the SOL, or 50 points if they are a successful PhD student.

881 Australian-sponsored Overseas Student visa

  • applicants must have a satisfactory skills assessment for a nominated skilled occupation assigned at least 50 points on the SOL, and have an eligible relative .

882 Designated Area-sponsored Overseas Student visa

  • applicants must simply have a satisfactory skills assessment for any nominated skilled occupation that carries 40 points or more, and have an eligible relative sponsorresiding in a designated area.
